Terms of Service

These Terms of Service (the “Terms”) govern the use of the Tus Momentos por siempre platform (the “Platform,” the “Service,” and also the “Owner,” “we,” “us”). By registering or using the Service, you accept these Terms and our Privacy Notice. If you do not agree, do not use the Platform.

The Platform is a professional tool that lets photographers (the “User,” “you”) upload, organize, share via PIN-protected links, and deliver photographs to their own clients, along with related management features. The Platform acts as a hosting and tools provider; it does not produce, edit, review, or endorse the content Users upload.

The Service is aimed at users in Mexico and Latin America. To use it you must be of legal age and have the legal capacity to be bound. If you register on behalf of a company, you represent that you have authority to do so. Open registration does not mean we direct the Service at jurisdictions other than those indicated.

You are responsible for the accuracy of your information, for the confidentiality of your credentials, and for all activity carried out from your account. Notify us immediately of any unauthorized use at soporte@tusmomentossiempre.com.

You retain ownership of the photographs and materials you upload (the “Content”). We do not claim any ownership rights over your Content; we only store, process, and display it to the extent necessary to provide you the Service. You grant us a limited, non-exclusive license for those technical purposes (storing, generating thumbnails, transmitting to your clients), which ends when the Content or your account is deleted.

You are solely responsible for the Content you upload and share. By using the Service you represent and warrant that, for each file:

• you hold the necessary copyright or authorizations;
• you have the consent of the people depicted (image rights) to upload, store, and share their image, and
• in the case of minors, you have the consent of whoever holds parental authority or guardianship.

Do not upload content that is illegal, that infringes third-party rights, that is offensive, or that does not belong to you. The Platform is a technical intermediary and does not control or assume responsibility for Users' Content.

If you believe Content hosted on the Platform infringes your rights (copyright, image rights, or others), send us a notice at soporte@tusmomentossiempre.com including: your contact details, identification of the right allegedly infringed, the location (link) of the Content, and a good-faith statement. After receiving a valid notice, we may remove or disable access to the Content in question. Accounts with repeated infringements may be suspended or deleted. Responsibility for the Content rests with the User who uploaded it.

You may not: compromise the security of the Platform or other users' access; use the Service for unlawful purposes; impersonate others; or upload malicious software. Breach of this may result in suspension or termination.

Access is offered through subscription plans (storage and features). The subscription renews for successive periods until you cancel it. You can cancel at any time and will keep access until the end of the period already paid for. If you stop paying, your account may be suspended and, after a grace period, your Content may be permanently deleted. Prices and billing terms are disclosed when payment is activated.

Each plan has storage and feature limits, published on the pricing page. Where a plan states that there is no cap on the quantity of an item — for example, the number of galleries — this means only that we do not limit that quantity; use remains subject to the storage included in the plan. Once you reach your plan's storage, you will not be able to upload more files until you free up space or change plans.

We may suspend or terminate your account for breach of these Terms, non-payment, or misuse, depending on severity, and there may be no refund. You may also close your account whenever you wish.

The Service is provided “as is” and “as available,” without warranties of uninterrupted or error-free operation, or that no data loss will occur. We recommend you always keep your own backups of important Content.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, or consequential damages, or for loss of data, revenue, or profits. Our total liability to you, for any cause, is limited to the amount you paid for the Service in the twelve (12) months prior to the event giving rise to the claim.

You agree to hold harmless and indemnify the Owner, its collaborators, and providers, against any claim, damage, or expense (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms or of third-party rights.

Galleries are shared through a link and a PIN. This mechanism makes it easy for your clients to access their galleries, but it is not a foolproof security system: anyone with the link and the PIN will be able to view the gallery. Avoid uploading highly sensitive content and share the PIN with care.

The processing of personal data is governed by our Privacy Notice, which forms part of these Terms.

We may amend these Terms. We will publish the current version with its update date. Continued use of the Service after a change constitutes acceptance of it.

These Terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the jurisdiction of the competent courts of the United Mexican States, waiving any other venue that might apply to them.
