Privacy Notice

Tus Momentos por siempre (the “Controller”) is responsible for the processing of your personal data under this Notice. Privacy contact: privacidad@tusmomentossiempre.com.

We process the following personal data:

• From the photographer (account holder): name, email address and, where applicable, banking details you choose to save to charge your clients, and billing details once payment is activated.
• From your clients: the email address you register to send them access or notices.
• Content you upload: photographs that may contain the image of identifiable people. A person's image is personal data; you are the one who obtains consent from the people depicted.
• Technical data: the data necessary to operate the service (account identifiers, basic activity logs).

Primary (necessary for the service): creating and administering your account; storing and displaying your galleries; enabling photo selection and delivery; sending transactional emails (access, selection and delivery notices); managing your subscription and, where applicable, billing.

Secondary (optional): improving the service and sending you communications about updates. You may object to the secondary purposes by writing to privacidad@tusmomentossiempre.com, with no effect on the provision of the service.

To operate the service we use providers who process data on our behalf and who may store or process information outside Mexico (international transfer):

• Google Firebase / Google Cloud (data and file hosting);
• Vercel (site hosting);
• Resend (sending transactional emails).

These providers process the data solely to provide us their services. We do not sell your personal data. Except where legally required, we do not share it with third parties for purposes other than those described here.

You have the right to Access, Rectify, Cancel, or Object to the processing of your data (ARCO rights: access, rectification, cancellation and objection), as well as to limit their use or disclosure and to revoke your consent. If you are located in another country, we will honor your equivalent rights of access, rectification, erasure, portability, and objection.

To exercise them, write to privacidad@tusmomentossiempre.com stating your request and a way to verify your identity. We will respond within the timeframes set by applicable law.

We currently use only the cookies and local storage strictly necessary or functional for the service to work (for example, to keep your session and your preferences). If in the future we add non-essential cookies (analytics, marketing, or third-party cookies such as payment gateways), we will update this Notice and request your consent through a cookie notice before installing them.

This site stores a functional cookie called paisVisitante in your browser. It contains only the two-letter code of the country from which you are connecting (for example, MX). It is used for a single purpose: to show you the price of the plans with the tax and currency information that applies to you. It contains no data that could identify you, it is not shared with third parties, and it is not used for advertising or analytics. It is deleted when you close your browser, and you can remove it at any time from your browser settings without affecting how the service works.

We keep your data while your account is active and for the periods necessary to comply with legal obligations. If you cancel your account or stop paying, your Content may be permanently deleted after the applicable grace period.

We apply reasonable technical and organizational measures to protect your data. No system is completely foolproof; your clients access galleries through a link and a PIN, so we ask you to share them with care.

The service is aimed at adult professionals. When the Content includes images of minors, you are responsible for having the consent of whoever holds parental authority or guardianship.

We may update this Privacy Notice. We will publish the current version with its update date on this page.

In Mexico, the data protection authority is INAI (the National Institute for Transparency, Access to Information and Personal Data Protection, inai.org.mx), with whom you may file a complaint. For any privacy matter, contact us at privacidad@tusmomentossiempre.com.
